Pay Fixation & Pay Anomaly Matters (6th & 7th CPC, MACP)

Pay fixation errors are among the most common problems faced by serving personnel and pensioners, and among the easiest to overlook. When a pay commission is implemented, or on promotion or MACP, personnel have to choose how their pay is fixed. If the option form is missed or submitted late, the default option is applied, often leaving the person drawing less every month than a coursemate or junior. The error then carries into later pay and pension. The Armed Forces Tribunal has repeatedly held that the pay authorities are responsible for fixing pay in the most beneficial manner, and the Delhi High Court upheld this position in May 2025. Adv. Bansal reviews your pay slips and promotion history, compares them with similarly placed personnel, and takes the matter before the AFT where required.

Who Is This For

  • Serving personnel drawing less basic pay than a coursemate or junior in the same trade
  • Personnel promoted between January 2006 and October 2008, during the 6th CPC transition
  • Personnel promoted around the 7th CPC implementation in 2016
  • Personnel granted MACP whose pay was fixed on the default option
  • Retired personnel whose pension is lower because of an earlier pay fixation error

Common Situations

  • Pay option form not submitted, or treated as late, and the default option applied
  • Basic pay lower than a coursemate or junior after promotion or MACP
  • Representation rejected on the ground that the option cannot be changed after the due date
  • Pay fixation error on promotion during the 6th CPC transition carried into 7th CPC pay
  • Pension fixed on incorrect last pay drawn
  • Arrears not paid after re-fixation

Frequently Asked Questions

My pay office says the option cannot be changed after the due date. Is that final?
No. The Armed Forces Tribunal has repeatedly held that the pay authorities must fix pay in the most beneficial manner, even when the option was not exercised on time. The Delhi High Court upheld this position in May 2025.
Can serving personnel file these cases?
Yes. Most pay fixation cases are filed by serving personnel.
Will re-fixation also correct my pension?
Where pay was fixed incorrectly before retirement, the Tribunal's directions have included consequential benefits, including pension where applicable. Each case depends on its facts.
Does this apply to officers?
Yes. The Tribunal has directed reviews of pay fixation for officers as well as Junior Commissioned Officers and Other Ranks.
